Confidentiality and cookies policy

CARGO edits and operates the website accessible at the following address: https://www.groupe-cargo.com/ (hereinafter referred to as the SITE) which is a non-commercial site intended to present the ranges and products of the company. In the context of the operation of the SITE, CARGO pays particular attention to respect the privacy and personal data of site users (hereinafter referred to as the USERS or the USER). CARGO commits to implementing appropriate measures for compliance with the principles of the modified Data Protection Act no. 78-17 of 6 January 1978, as well as European regulation 2016/679 on the protection of individuals regarding the processing of personal data and the free circulation of that data. The purpose of the current policy covering the confidentiality and management of cookies is to inform SITE USERS about how their personal information may be collected and processed by CARGO.

1. IDENTITY OF THE PERSONAL DATA PROCESSING MANAGER

2. DATA COLLECTION AND PROCESSING

In the context of the operation of the SITE, CARGO may collect the personal data of USERS. These data are processed according to the purposes described in article 3 of the current confidentiality policy.

CARGO may also collect personal data:

  • In response to information requests, complaints or any contact made by a USER with the CARGO customer service department.
  • In response to information requests or emails adressed directly to CARGO.
  • At the moment of access to the site by the USER.

Whatever the collection mode, CARGO commits to inform the USER about the purpose of the processing, whether responses are compulsory or voluntary, potential consequences, as far as it is concerned, of a lack of response, about recipients of the data, arrangements for exercising rights of access and rectification, rectification and opposition to the processing of their data.

Data that may be collected and processed by CARGO for fulfilment of the purposes described in article 3 of the current confidentiality policy include:

  • identification data of USERS:
    title, surname, first names, postal address, telephone numbers and email addresses, copy of identity card if applicable, copy of identity document for the purposes of proving exercise of access right, rectification or opposition or to respond to a legal obligation.
  • USER connection data (IP addresses, technical data).

3. PURPOSES OF PROCESSING

These different data are collected to ensure:

  • correct operation of the SITE
  • management of various requests expressed via the contact form
  • management of requests for right of access, rectification and opposition concerning personal data processed by the Company CARGO
  • development of statistics intended to improve the operation of the SITE.

The Company CARGO may communicate these data for legal and/or regulatory purposes.

4. DURATION OF DATA RETENTION

The Company CARGO commits to retain the collected data in a form that allows identification of the persons concerned for a duration not exceeding the duration required for the purposes they are collected and processed.

Personal data relating to USERS may not be retained beyond the duration required for management of commercial relations, with the exception of certain data archived according to provisions currently in force (for example, those provided by the French Commercial Code, the French Civil Code and the French Code of Consumption), when their retention is required to establish proof of a right or a contract or a document for compliance with a legal obligation.

By way of exception, identification data relating to USERS are retained in the following instances:

  • Up to three (3) years after the end of the commercial relationship
  • Up to three (3) years after their collection by the Company CARGO or after the last contact coming from prospective customers.

At the end of this period of three (3) years, the Company CARGO may reconnect with USERS in order to find out if they wish to continue receiving commercial solicitations. In the absence of a positive response from them, their data will be deleted or archived according to the provisions in force.

5. RIGHTS OF USERS

It should be noted that USERS whose personal data are processed benefit from rights of access, rectification and opposition to the processing of their personal data, according to article 38 and subsequent articles of modified law no. 78-17 of the Data Protection Act and as well as European regulation 2016/679 on the protection of individuals regarding the processing of personal data and the free circulation of that data.

USERS also benefit from certain conditions governing a right to the deletion of their data as well as a right to the portability of their data. Additionally, in accordance with law no. 2016-1321 of 7 October 2016 for a digital Republic, USERS benefit from the ability to give instructions about the fate of their personal data after their death.

These rights may be exercised be sending a simple request by paper mail to the head office of the Company CARGO, or by sending an email to DPO@cargo-services.fr accompanied by proof of identity and a legitimate reason, if required by law.

When communicating documents containing proof of identity, these are retained for one (1) year in the case of collection for the purposes of verifying the identity of the USERS wishing to exercise their right of access or rectification and three (3) years in the case of collection for the purposes of verifying the identity of USERS wishing to exercise their right of opposition. The same applies to any data collected on the occasion of USERS exercising their right of opposition.

6. DATA RECIPIENTS

CARGO may be called upon to communicate personal data collected on the SITE to its internal departments, subcontractors, or commercial partners who ensure:

  • realisation of CONTENT of an advertising nature
  • realisation of commercial operations
  • monitoring of the commercial relationship with USERS
  • management of hosting and maintenance services on the SITE
  • control of CARGO activity (such as departments responsible for internal control procedures)

CARGO furthermore reserves the right to transmit personal data collected on the SITE in order to meet its legal obligations, particularly if it was obliged to do so through legal requisitions.

7. CONNECTION DATA AND COOKIES

THE Company CARGO uses connection data (date, time, Internet address, USER's computer protocol, page viewed) and cookies (small files saved on the USER's computer) that allow it to identify the latter, memorise their consultations and benefit from SITE measurements and statistics, particularly those relating to viewed pages. This SITE uses functional and technical cookies mainly allowing it to improve your navigation. These cookies send information to our site and to your browser: information relating to a form (identifier, address), display preferences of your terminal (language, resolution), and security measures such as the expiry of your current session, etc. The navigation software accepts cookies present on websites by default. However, you retain control of the installation of these cookies because you have the option to configure your navigation software to:

  • Accept or refuse cookies found on the SITE
  • Refuse all cookies systematically
  • Request your approval on each of the cookies you encounter during your internet navigation.

We would like to inform you that, by choosing to block cookies, certain SITE functionalities and navigation facilities may be disabled.

In any case, the cookies stored on your terminal or any other similar element used to identify you for statistical or audience purposes will have a limited maximum lifespan of 13 months; this duration is not automatically extended during your subsequent visits to the SITE. Hereafter, the raw use data associated with an identifier are either deleted or anonymised.

8. SECURITY

CARGO takes useful precautions with regard to the nature of data and the risks presented by processing them in order to preserve data security and, in particular, avoid them being garbled, damaged, or prevent unauthorised third parties from gaining access.
